Terms of Service

Binding terms for using MatchWell's Digital Twin Dating services

1. About MatchWell

MatchWell is operated by Virtual Connect Group (California, United States). We create AI-powered Digital Twins that conduct preliminary conversations on your behalf. Digital Twins are AI, not humans, and will be identified as such to other users.

1.1 AI Disclosure (SB 243)

  • Digital Twins are artificially generated companion chatbots and are not human.
  • Companion chatbots may not be suitable for some minors. Our service is 18+ only.
  • Clear disclosure appears during onboarding and in every Twin conversation.

2. Eligibility and Account

  • You must be 18+ to use the service.
  • You attest you are not a registered sex offender, have no disqualifying violent crimes, and are legally allowed to use the service.
  • You are responsible for account security and all activity on your account.

3. No-Ghosting Commitment

You agree to the No-Ghosting Agreement (Appendix A). Provide closure on active connections and allow your Digital Twin to deliver graceful closure messages. Repeated ghosting can reduce matching priority or lead to suspension/termination.

4. Subscriptions and Payments

  • Free tier: voice onboarding, Digital Twin creation, 3 connection slots, 3 Twin dates per connection, graceful closure; no photos.
  • Premium tier: $14.95/mo or $149.95/yr; 15 slots, photos, unlimited Twin dates, Voice Bridge, compatibility reports, monthly calibration.
  • Automatic renewal unless cancelled 24 hours before renewal. Cancellation is effective end of current period.
  • No refunds. All purchases are final except where required by law. California subscribers may request a refund until midnight of the third business day after subscription.

By using MatchWell you consent to recording, processing, and storing your voice for onboarding, calibration, and Voice Bridge; generating AI responses; and using anonymized/aggregated data to improve AI (you may opt out of model improvement in Privacy Settings).

6. User Conduct

  • No harassment, hate, violence, impersonation, spam, or commercial use.
  • No manipulation of Digital Twins to deceive or abuse others.
  • We may moderate or remove content and enforce suspensions/termination for violations.

7. Privacy

Our collection and use of data is governed by the Privacy Policy and Cookie Policy. You may exercise rights (access/know, delete, correct, do-not-sell/share, limit sensitive information) via Privacy Settings or by email to privacy@matchwell.ai.

8. Intellectual Property

All software, algorithms, designs, and content (excluding your content) belong to Virtual Connect Group.

9. Disclaimers

Services are provided “as is”. We do not guarantee uninterrupted service, accurate matches, successful relationships, or that Digital Twins will perfectly represent you.

10. Limitation of Liability

To the maximum extent permitted by law, liability is limited to the greater of amounts paid in the last 12 months or $100. No liability for indirect, incidental, or consequential damages.

11. Indemnification

You agree to indemnify Virtual Connect Group against claims arising from your use or violations.

12. Termination

You may terminate anytime; your Twin will deliver closure messages before deactivation. We may suspend/terminate for violations, legal requests, discontinuation, or extended inactivity.

13. Governing Law

California law governs. Venue: Los Angeles County, CA (unless arbitration applies).

14. Dispute Resolution & Arbitration

  • Informal resolution first by contacting legal@matchwell.ai (60 days).
  • Binding individual arbitration (AAA Consumer Rules). No class actions or representative claims.
  • Small claims carve-out; sexual assault/harassment claims exempt per law.
  • Opt-out within 30 days of account creation by emailing legal@matchwell.ai with required details.

15. General

  • Entire agreement includes Terms, Privacy Policy, Cookie Policy, Community Guidelines, AI & Voice Consent, and No-Ghosting Agreement.
  • We may update Terms with 30 days notice for material changes.
  • Severability and no waiver clauses apply; assignment requires consent (we may assign).
